Terms of Service

These Terms of Service ("Terms") govern your use of the Pawker mobile application and website at pawker.com (collectively, the "Service"), operated by DrowsyFox LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use Pawker. If you are between 13 and 18 years old, you represent that you have your parent's or guardian's consent to use the Service.

2. Educational Purpose

Pawker is a poker education platform. It teaches poker concepts through lessons, quizzes, and practice scenarios. Pawker does not involve real-money wagering, gambling, or betting of any kind. It is not a gambling service, and no feature of Pawker allows you to win, lose, or transfer real money.

3. Your Account

You are responsible for maintaining the security of your account credentials. You may not share your account with others. One account per person. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Virtual Currency (Gems)

Pawker includes an in-app virtual currency called "Gems." Gems have no real-world monetary value. They cannot be exchanged for real money, cannot be transferred between users, and cannot be cashed out. DrowsyFox LLC reserves the right to modify the gem economy, including pricing and availability, at any time.

5. Subscriptions

Pawker Pro is available as a subscription (monthly or annual) or a one-time lifetime purchase, processed through the Apple App Store or Google Play Store.

  • Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription in your device's subscription settings.
  • Refunds are handled by Apple or Google in accordance with their respective refund policies.

6. User Content

When you submit feedback, bug reports, feature requests, or flag questions, you grant DrowsyFox LLC a non-exclusive, royalty-free license to use that content for the purpose of improving the Service. You retain ownership of your submissions.

7. Leaderboard

Your display name and weekly experience points (XP) are visible to other users on the leaderboard. Do not use personally identifiable information as your display name.

8. Prohibited Conduct

You agree not to:

  • Cheat, exploit bugs, or manipulate progress data
  • Reverse engineer, decompile, or disassemble the Service
  • Impersonate another person or entity
  • Scrape, crawl, or use automated means to access the Service
  • Use the Service for any unlawful purpose
  • Interfere with or disrupt the Service or its infrastructure

9. Intellectual Property

All content in the Service — including curriculum, lessons, graphics, logos, mascot design, and branding — is the property of DrowsyFox LLC and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the app's settings, which will permanently remove all your data.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that using Pawker will improve your poker skills. Pawker is not financial advice, investment advice, or gambling advice.

12. Limitation of Liability

To the maximum extent permitted by law, DrowsyFox LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

13. Dispute Resolution

Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to resolve disputes on an individual basis and waive any right to participate in a class action. Either party may seek relief in small claims court as an alternative.

This arbitration clause does not apply to users located in the European Union or United Kingdom, where local consumer protection laws prevail. Users in the EU/UK may bring claims in their local courts in accordance with applicable law.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws provisions.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the app or by posting a notice on our website. Your continued use of the Service constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
